HARBOR REGULATIONS
In addition to the HISWA conditions the following, self-evident rules apply on the harbor premises.
MARINA WATERFRONT HARBOR REGULATIONS

Article 1: General
1.1. These regulations shall apply to all berth holders, visitors and users of the marina facilities of Marina Waterside
1.2. The purpose of these regulations is to promote safety, maintain order and provide a pleasant and clean environment for all users of the harbor.
1.3. Every berth holder is obliged to observe these regulations and strictly follow any instructions given by the harbor staff.
1.4. Everyone on the marina shall maintain order, quietness and cleanliness and observe safety, avoiding disruptive behavior.Article 2: Allocation and Use of Berths.
2.1. Berths are assigned by the harbor manager. Berth holders shall use their berth in an orderly manner and comply with the instructions of the harbor staff.
2.2. It is not allowed to change berths without permission of the harbor manager.
2.3. It is the responsibility of the berth holder to properly moor his/her vessel and ensure that it does not cause damage to other vessels or port facilities.
2.4. All assigned vessels must permanently meet the following criteria: presentable, well maintained, ready to sail and with proper facilities for mooring lines.
2.5. It is prohibited to occupy berths that have not been agreed upon or designated.Article 3: Prohibition of Occupancy on Board
3.1. Occupancy of the boat is prohibited at all times.
3.2. As for the period of occupancy, three months or more per year is a reasonable standard. This distinguishes between recreational use and a situation where the boat is used as a primary residence. Occupancy is defined as the continuous presence on the boat for an extended period of time without regular movement of the boat, and the use of the boat as a primary residence or permanent home. Characteristics of habitation include the performance of daily household activities, such as cooking, washing and the structural use of household equipment on board.
3.3. The Port Authority reserves the right to take appropriate measures in case of occupancy, including termination of the berth agreement.Article 4: Use of Jetties and Mooring Poles
4.1. It is strictly prohibited to make changes to jetties, mooring posts or other harbor facilities without written permission.
4.2. Damage caused by unauthorized adjustments will be repaired entirely at the expense of the person causing the damage.
4.3. Scaffolding shall be free of obstruction or materials at all times.Article 5: Safety and Environment
5.1. Port users must observe safety and adhere to safety regulations.
5.2. It is forbidden to discharge waste, oil, fuel or other polluting materials into the port. Waste shall be deposited in the containers provided for that purpose.
5.3. Open fires, including barbecues, are not allowed on the jetties or aboard ships in the harbor unless otherwise stated.
5.4. Engines may be started only to move the vessel, and the maximum speed in the harbor is 5 mph.Article 6: Maintenance and Repairs
6.1. Maintenance and minor repairs are allowed provided they do not cause a nuisance and comply with environmental regulations.
6.2. Major repairs must be carried out outside the port.
6.3. Performing maintenance work such as drilling, welding, sanding, grinding, painting and similar work is prohibited in the port.Article 7: Access to the Port and Facilities
7.1. Access is reserved for berth holders and their guests. Visitors must report to the harbor master.
7.2. One vehicle per berth is allowed in the port area; other vehicles must be parked outside the barrier and may not be parked here.
7.3. Pets are allowed if leashed and without causing a nuisance.
7.4. Sharing of access codes or keys is prohibited. Gates must be closed at all times.Article 8: Rules of conduct
8.1. Berth holders and visitors must behave in a manner that respects the peace and enjoyment of the harbor environment.
8.2. Excessive noise, including loud music, talking or other disruptive behavior, is not permitted.
8.3. Berth holders are responsible for the behavior of their guests.
8.4. Drugs and public drunkenness are not permitted on the harbor grounds.Article 9: Enforcement and Sanctions
9.1. Port staff is authorized to enforce compliance with these regulations. Violations may result in warnings, fines, or in serious cases, the dissolution of the mooring agreement.
9.2. For repeated or serious violations, the mooring may be terminated without entitlement to a refund of mooring fees.Article 10: Additional Provisions
10.1. Mooring fees are non-refundable.
10.2. If an access key is lost, €50 will be charged.
10.3. Jachthaven Waterkant B.V. and the harbor master are not liable for damage, loss or theft of goods unless this is the result of a demonstrable shortcoming on their part.
10.4. Upon termination of a berth, the key must be returned.
