Marina rules and terms

This is how we keep the marina safe, clean and pleasant for everyone. You can also download the HISWA terms and conditions as a PDF (in Dutch).

The rules at the marina

In addition to the HISWA terms and conditions for moorings and storage, the following common-sense rules apply at the marina. This is a translation; the Dutch version is legally binding.

Article 1 · General

1.1These rules apply to all berth holders, visitors and users of the facilities of Jachthaven Waterkant.

1.2The purpose of these rules is to promote safety, maintain order and ensure a pleasant, clean environment for everyone using the marina.

1.3Every berth holder must comply with these rules and strictly follow any instructions from marina staff.

1.4Everyone at the marina must keep order, peace and cleanliness, observe safety and avoid causing a nuisance.

Article 2 · Allocation and use of moorings

2.1Moorings are allocated by the harbour management. Berth holders must use their mooring in an orderly manner and follow the instructions of marina staff.

2.2Changing moorings without permission from the harbour management is not allowed.

2.3Berth holders are responsible for mooring their vessel properly and ensuring it does not damage other vessels or marina facilities.

2.4All assigned vessels must permanently meet the following criteria: presentable, well maintained, seaworthy and properly equipped with mooring lines.

2.5Occupying moorings that have not been agreed or assigned is prohibited.

Article 3 · No living on board

3.1Living on board is prohibited at all times.

3.2As a guideline, staying on board for three months or more per year counts as living on board. This distinguishes recreational use from using the boat as a primary residence. Living on board means being continuously present on the boat for a longer period without regularly moving the vessel, and using the boat as a main or permanent residence. Signs of living on board include daily household activities such as cooking, washing and regularly using household appliances on board.

3.3The harbour management reserves the right to take appropriate action if a boat is lived on, including termination of the mooring agreement.

Article 4 · Use of jetties and mooring posts

4.1Making changes to jetties, mooring posts or other marina facilities without written permission is strictly prohibited.

4.2Damage caused by unauthorised changes will be repaired entirely at the expense of whoever caused it.

4.3Jetties must be kept clear of obstructions and materials at all times.

Article 5 · Safety and environment

5.1Users of the marina must observe safety and follow the safety regulations.

5.2Discharging waste, oil, fuel or other pollutants into the marina is prohibited. Waste must be placed in the designated containers.

5.3Open fires, including barbecues, are not allowed on the jetties or on board vessels in the marina, unless stated otherwise.

5.4Engines may only be started to move the vessel; the speed limit in the marina is 5 km/h.

Article 6 · Maintenance and repairs

6.1Maintenance and minor repairs are allowed, provided they cause no nuisance and comply with environmental rules.

6.2Major repairs must be carried out outside the marina.

6.3Maintenance work such as drilling, welding, sanding, grinding, painting and similar activities is prohibited in the marina.

Article 7 · Access to the marina and facilities

7.1Access is reserved for berth holders and their guests. Visitors must report to the harbour master.

7.2One vehicle per mooring is allowed on the marina grounds; other vehicles must be parked outside the barrier and may not be stored there.

7.3Pets are allowed provided they are kept on a lead and do not cause a nuisance.

7.4Sharing access codes or keys is prohibited. Gates must always be closed.

Article 8 · Rules of conduct

8.1Berth holders and visitors must behave in a way that respects the peace and enjoyment of the marina.

8.2Excessive noise, including loud music, talking or other disturbing behaviour, is not allowed.

8.3Berth holders are responsible for the behaviour of their guests.

8.4Drugs and public drunkenness are not permitted at the marina.

Article 9 · Enforcement and penalties

9.1Marina staff are authorised to enforce these rules. Violations may lead to warnings, fines or, in serious cases, termination of the mooring agreement.

9.2In the event of repeated or serious violations, the mooring may be terminated without any right to a refund of mooring fees.

Article 10 · Additional provisions

10.1Mooring fees are non-refundable.

10.2A charge of €50 applies for a lost access key.

10.3Jachthaven Waterkant B.V. and the harbour master are not liable for damage, loss or theft of goods, unless this results from a demonstrable failure on their part.

10.4The key must be returned when a mooring agreement ends.
